Copyright and Use of Farson Digital Watercams Content

1. Personal use

4. Copyright ownership

Unless expressly stated otherwise, copyright in photographs, webcam images, archive images, high-resolution photographs, video clips, graphics and other original content produced by or for Farson Digital Watercams is owned by, licensed to, or used with permission by Farson Digital Ltd.All rights are reserved.Material being publicly visible on the Farson Digital Watercams website does not place that material in the public domain.No ownership, copyright, publication or redistribution rights are transferred merely because a person is able or permitted to view the material.Where material belongs to a third party, the relevant third-party rights remain unaffected.

5. Screenshots and screen recordings

7. Archive images

Historic Farson Digital Watercams images remain protected by copyright.Access to the Farson Digital Watercams archive provides a right to view the material only, unless a separate right has been specifically granted in writing by Farson Digital Ltd.Archive material must not, without prior written permission, be:
  • systematically downloaded;
  • copied in bulk;
  • reproduced as a collection;
  • incorporated into another archive;
  • supplied to third parties;
  • published elsewhere;
  • distributed through another website or service;
  • used to construct a separate image or data library;
  • used to create or support a competing image, webcam, environmental-monitoring or data service.
The age of an image does not itself remove or reduce its copyright protection.

8. High-resolution images and video

9. Commercial, business and professional use

Access through a Farson Digital Watercams business product does not automatically confer redistribution, publication or onward-supply rights.Any commercial or business licence applies only to the uses specifically agreed in writing by Farson Digital Ltd.

10. No onward supply

14. Alteration, branding and identification

Without the prior written permission of Farson Digital Ltd, you must not remove, obscure or alter any:
  • Farson Digital Watercams logo or branding;
  • copyright notice;
  • timestamp;
  • location identification;
  • watermark;
  • metadata;
  • attribution;
  • other ownership or identification notice.
Farson Digital Watercams material must not be edited, manipulated or presented in a manner which falsely represents its location, date, time, source, circumstances or meaning.Written permission to reproduce an image does not include permission to alter it unless that has also been specifically agreed.

15. Third-party environmental data

Some information displayed through Farson Digital Watercams, including river level, flow, rainfall, tide, weather and other environmental information, is obtained from third-party organisations.Such information may be subject to separate copyright, database rights, attribution requirements, licences and terms of use.Farson Digital Ltd does not claim ownership of third-party material where the relevant rights belong to another organisation.The display of third-party information through Farson Digital Watercams does not give a user any additional rights to reproduce or commercially exploit that information.Users requiring onward or commercial use of third-party data should comply with the terms imposed by the relevant data owner or provider.

Logos, trademarks, photographs and other material provided by camera hosts, sponsors, partners or other third parties remain the property of their respective owners where applicable.Nothing displayed through Farson Digital Watercams grants a right to reproduce or use such third-party material.Where permission is required, it must be obtained from the relevant rights holder.

17. Farson Digital and Farson Digital Watercams branding

The names Farson Digital, Farson Digital Watercams, the Farson Digital Watercams logo and associated branding must not be reproduced or used in a way that implies sponsorship, partnership, endorsement, approval or association with Farson Digital Ltd without the prior written permission of Farson Digital Ltd.

18. Copyright exceptions

Nothing in these provisions is intended to prevent any use which is lawfully permitted under applicable copyright law and which Farson Digital Ltd cannot lawfully restrict.Copyright law provides certain limited exceptions in particular circumstances.Whether an exception applies depends upon the nature of the material and the particular proposed use.Where a proposed use is not clearly covered by a legal exception, the user should obtain the prior written permission of Farson Digital Ltd before publishing, reproducing, broadcasting or redistributing Farson Digital Watercams material.

19. Permission and licensing

20. Unauthorised use

Farson Digital Ltd reserves all rights in relation to unauthorised copying, publication, redistribution, broadcasting, commercial exploitation or other unauthorised use of Farson Digital Watercams material.Where unauthorised use is identified, Farson Digital Ltd may require the material to be removed and may pursue any further remedies available under applicable law.A claim that verbal permission was given does not constitute evidence of permission under these terms.
